Terms of Service

These Terms of Service constitute an agreement between users of the AdsLuma platform (the “Platform”) and ADSERA Bilişim ve Yazılım Hizmetleri Limited Şirketi (“Company” or “AdsLuma”). By registering or using the Platform, you accept these terms.

1. Service Description

AdsLuma is a SaaS platform that unifies advertising and analytics sources such as Google Ads, Meta Ads, Google Analytics 4, Google Search Console, and provides AI-powered analytics, optimization and content generation services.

2. Account and Security

• You must be at least 18 years old and have legal capacity to create an account.
• You represent that information you provide is accurate, current and complete.
• You are responsible for the security of your account (password, sessions, team permissions).
• You are responsible for all activity under your account.
• You agree to notify us immediately of any unauthorized access or security breach.

3. Acceptable Use

You agree NOT to:

• Generate content unlawful, contrary to public order, morality or third-party rights;
• Send spam, conduct phishing, fraud or distribute malware;
• Attack platform infrastructure (DDoS, port scan, brute force, etc.);
• Attempt unauthorized access to other users' data;
• Reverse engineer, copy or resell the platform;
• Misuse AI features (jailbreak, prompt injection, illegal content);
• Infringe intellectual property rights (copyright, trademark, patent);
• Exploit third-party API quotas (Google Ads, Meta) and affect other users.

4. Third-Party Services

AdsLuma connects to third-party APIs (Google, Meta) to function. Their terms, pricing, and service levels are outside our control. AdsLuma is not liable for service interruptions or policy changes from these providers.

5. AI Services

• AI responses are informational; the final decision is always yours. AI outputs are not investment, legal or medical advice.
• Verify marketing recommendations against your business context before applying.
• AI-generated content (blog, creative, copy) is the User's responsibility — review before publishing.
• Copyright status of AI-generated content depends on the provider; check before use.

6. Subscription and Pricing

• The platform offers 4 plans: Free, Scaler, Pro, and Agency.
• Monthly or annual billing options. Annual plans usually discounted.
• Each plan has specific AI token quota, integration count and feature set.
• Quota overage triggers a notification; you can buy extra packs or upgrade.
• Payments are processed via Stripe; credit card details are not stored on AdsLuma servers.
• Refund policy: Unconditional 14-day refund (even if used). After this period, mid-period refunds are not granted.

7. Suspension and Termination

AdsLuma reserves the right to suspend or close your account, with or without notice, in cases including:

• Violation of these Terms;
• Unpaid invoices (over 30 days);
• Activity threatening platform security or other users;
• Repeated AI jailbreak or cross-tenant probing;
• Legal authority request.

You may close your account anytime from Settings. Data is deleted within 30 days.

8. Intellectual Property

• The AdsLuma platform, source code, logo, brand name, design and content are owned by ADSERA.
• Content you upload or generate (creative, text, brief, campaign data) belongs to you. AdsLuma has a limited license only to provide the service.
• Use of AdsLuma logo, brand or design elements without permission is prohibited.

9. Limitation of Liability

The platform is provided “as-is”. To the maximum extent permitted by law:

• AdsLuma does not guarantee uninterrupted or error-free service.
• Not liable for AI output accuracy, completeness or business impact.
• Not liable for third-party platform changes (Google Ads API updates, etc.).
• Total compensation liability cannot exceed the amount paid by the User to AdsLuma in the last 12 months.

The above limitations do not apply in cases of intent or gross negligence.

10. Backup and Service Level

• AdsLuma performs daily automatic database backups.
• Monthly target uptime: 99.5%. Planned maintenance windows are announced in advance.
• User is responsible for backing up their critical content (Settings → Data Export).

11. Changes

These Terms may be updated from time to time. Significant changes are communicated via email or in-app notice at least 14 days in advance. Continued use after a change constitutes acceptance of the new terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Türkiye. Disputes arising from or related to these Terms shall be subject to the jurisdiction of Istanbul (Çağlayan) Central Courts and Enforcement Offices.
